It is unlikely that a summary eviction proceeding (see What are the laws governing landlords and tenants? - Ask a Law Librarian) could succeed in this scenario, for reasons that a lawyer with landlord-tenant expertise could explain; see, inter alia, Landry v Harris and the cases cited therein. A residential ejectment action may be a viable legal avenue to pursue, in consultation with expert counsel. But before going this route, with or without a lawyer, the Office of Court Administration wants all to be aware of New York's Community Dispute Resolution Centers, "a statewide network of nonprofit organizations providing dialogue and dispute resolution services" to families, including low- or no-cost help with housing matters, financial and contractual disputes, and other family issues.
