What is a Dunaway Hearing?

What is a Johnson hearing?

Answer

Court Help defines a Dunaway Hearing thus: The Court must decide whether the police had enough probable cause to make an arrest. Dunaway hearings are always held at the same time as a Mapp, Huntley, or Wade hearing

Dunaway v NY 442 US 200 (1979).

See Criminal Procedure Law 140.05 Arrest Without a warrant; in general

Court Public Access Law Libraries' materials include extensive discussion of Dunaway hearings.

Cases often refer to Dunaway/Johnson hearings.  These hearings require that the People prove that a police action was lawful.
