What is a cross-motion?

I want to prepare a cross-motion. How do I do that?

Answer

A cross-motion is a motion made against the moving party. A cross-motion is returnable at the same time and place as the original pending motion. "Returnable" means the date when a court paper must be filed, delivered, or argued in court, or the date when a specific court action must be completed by. Like any motion, a cross-motion is deemed made when the notice of cross-motion is served, not when the original motion is made. § 249. Cross-Motion, Siegel, N.Y. Prac. § 249 (6th ed.)

Section 2215 of the Civil Practice Law and Rules governs how to serve a cross-motion.
