The hardship declaration is a form authorized by L 2020, ch 381, COVID-19 Emergency Eviction and Foreclosure Prevention Act of 2020 and L 2021, ch 417 that extends the eviction and foreclosure moratorium to Jan 15, 2022. There are separate hardship declaration forms for eviction and foreclosure proceedings in the most frequently heard languages in the New York State Courts. Local court rules for eviction and foreclosure may also apply.
